Ohio Workers' Comp Laws

If You Were Injured On the Job, You Are Covered by Ohio Workers' Comp

Workers in the state of Ohio have two protections that guarantee their right to recover compensation under Ohio workers' compensation laws. First, workers' compensation is written into Ohio's state constitution. Second, under the Ohio Revised Code, our state law requires that employers provide workers' compensation insurance coverage for their workers. If an employer does not provide workers' compensation coverage, it is considered non-compliant and subject to paying the injured workers' costs and lost earnings directly out-of-pocket.

Are You Guaranteed to Keep Your Job?

In Ohio, injured workers are entitled to recover medical expenses and lost earnings under workers' comp laws, but you have no guarantee of job protection, unless you are protected by a collective bargaining agreement. Otherwise, employment in Ohio is at will and can be terminated at any time for any reason by the employer or the employee barring any discriminatory termination. Further, an employer cannot take adverse action against you for filing your injury claim, but is not required to offer you light duty upon your return or, for that matter, give you your job back at all.

What If You Didn't File Your Claim Immediately?

Many people don't think their initial workplace injury warrants filing a workers' compensation claim and seeking medical treatment. Unfortunately, too many injured workers wait a year or more before realizing that they are finally no longer able to work because their injury continued to worsen over time. Under the Bureau of Workers' Compensation (BWC) regulations, wage benefits are paid according to your earnings for the year prior to the date of accident or death, not the year you file. Generally speaking, the statute of limitations of a worker's compensation claim in Ohio is two (2) years from the date of injury. Time is of the essence.
